Terms of Use

  1. General

    1. Welcome and thank you for your interest in propertymap.mu (the "Website"). This Website is operated by Starting Gate Ltd (hereinafter referred to as “Company,” “propertymap.mu,” “us,” “our,” or “we”). Any person accessing or using the Website is referred to as “you,” or “Users”.

    2. The Company operates the Website as an online advertising and research service for private parties, owners, builders, agents, brokers, advertising agency and real estate agents listings or real estate agents/ companies and/or others (hereinafter collectively referred to as “Advertisers”).

  2. Acceptance of Terms of Use

    1. These terms and conditions tell you the terms on which you may use this Website to access the information, products, services and advertisements available through the Website (“Services”). By accessing, browsing or using the Services or any pages of the Services, you are indicating that you have read and acknowledge and agree to be bound by these terms and conditions and any additional terms and conditions applicable to certain areas of the Services and posted by us in those areas of the Services, which are incorporated herein by reference (collectively, “Terms of Use”), and the Website’s Privacy Statement

    2. By using the Website, you hereby agree that you are at least eighteen (18) years of age and bound by all of the following provisions of these Terms of Use. Click here to review the Website’s Privacy Policy. For purposes of these Terms of Use, the term "Website" shall include the Advertising Service, as described below.

    3. Certain Advertisers may be required to pay fees to create an account and access certain features of the Services. The Terms of Use shall apply indifferently whether you are a paid or unpaid subscriber of the Services.

  3. Advertising and Research Service

    1. Users of the Services can purchase several types of subscription plans (each, an “Account”) allowing you to access those portions of the Services described under each plan. You will be charged a subscription fee for the use of an Account. We reserve the right to change the fees at any time, upon notice to you. The increase will apply to the next payment due from you after the notice, provided that you have been given at least 10 days’ prior notice before the charge is made. If you are given less than 10 days’ prior notice, the price increase will not apply until the payment after the next payment due.

    2. The Company is not involved in negotiating, and is not compensated for any real estate or other transactions that arise out of interactions between Users of the Services and the Advertisers.

    3. The Company does not represent such Advertisers, does not provide real estate services to such Advertisers, and is never a party to or otherwise involved in any transaction between such Advertisers and/or buyers, sellers, landlords and tenants. By way of example and not limitation, the Company does not:
      • buy, hold in escrow, sell, insure, warrant, or guarantee any property advertised on the Website,
      • guarantee or ensure any transaction between any buyers and sellers/ landlords and tenants, or
      • collect or process payments or transfer title on behalf of buyers or sellers.

    4. The information presented on this Website (including, without limitation, square footage, price, and availability) is provided by the Users and is not guaranteed or warranted to be accurate or complete and is subject to change without notice. Please verify all information with the seller/landlord.

    5. Buying a property is considered a major financial decision and one of the most expensive purchases an individual can ever make. Please be advised that it is for you to satisfy yourself as to the price, condition, (or any other characteristic) of any property through your own due diligence and we shall accept no liability for any information featured on the Website. For the avoidance of doubt, we do not undertake to check or scrutinise such information.

  4. Advertising Service

    1. This Website may offer a publicly available self-service advertising product through which, Advertisers may purchase online property listings ("Ads") and manage those Ads once purchased (the "Advertising Service"). By purchasing an Ad, you acknowledge and agree that:
      • you have the right to list the advertised property for sale/rent;
      • you or your client is willing to sell/rent the listed property at the price and on any other terms specified in the Ad;
      • each Ad shall feature only one unique property (e.g., you cannot buy one Ad and advertise more than one property on that Ad, either simultaneously or consecutively);
      • upon selling the listed property or otherwise taking it off the market, you will promptly delete the Ad for that property;
      • you will not use the Advertising Service to advertise or promote anything other than the property for sale/rent and your real estate services in connection therewith; and
      • you will use User data solely to respond to property inquiries and will not sell, rent, lease, license, sublicense, or otherwise distribute or transfer User data to third parties or otherwise use User Data in any unauthorized manner, including for "spam", "junk mail", or direct marketing campaigns. Further,
        • you shall provide real estate services and otherwise operate in accordance with all applicable laws, rules, regulations, and codes of conduct, and
        • you shall provide all services to Users in a prompt, professional, honest, and courteous manner.
        You acknowledge and agree that certain Ads may need to be renewed or extended to remain on the Website. Generally, amounts paid for Ads are non-refundable except in limited instances. Due to processing time, there may be a delay in posting Ads to the Website.

    2. The information provided on this Website relating to all properties has been furnished to us by the Advertisers. We have not verified whether or not that information is accurate and do not have any belief in one way or the other in its accuracy. We do not accept any responsibility to any person for its accuracy and do no more than pass it on. All interested parties should make and rely upon their own inquiries in order to determine whether or not this information is in fact accurate.

  5. Property Information/Price

    1. You take full responsibility for the accuracy, completeness and veracity of any information provided by you or on your behalf to propertymap.mu and published on our Website («Property Information»).

    2. You agree to promptly inform propertymap.mu of:
      1. Any inaccuracies in the Property Information; and
      2. Any material changes which may affect the Property Information.

    3. Property Information including the price of any property are furnished by the Advertisers. The indicated price may change without notice.

    4. The price of properties may be listed in MUR and other currencies. Where the price is listed in any other currencies, conversion to MUR shall be automatically processed using the current day exchange rate, via Exchange rates API.

  6. Accounts and Registration

    1. You must be at least 18 years of age to use the Services. By agreeing to these Terms of Use, you represent and warrant that:
      • you are at least 18 years of age;
      • you have not previously been suspended or removed from the Services; and
      • your registration and your use of the Services is in compliance with all applicable laws and regulations.
      When you register for an account you will be asked to provide us with some information about yourself, such as email address, phone number, or other contact information. You agree that the information you provide is accurate and that you will keep it accurate and up-to-date at all times. When you register, you will be asked to provide a password. You are solely responsible for maintaining the confidentiality of your account and password, and you are responsible for all actions taken via your account. You may not share your Account(s) with others.

  7. Fees

    1. You may be required to pay fees to create your Account and access certain features of the Services. All fees are payable in advance and are non-refundable. If we change the fees for all or part of any of the Services, including by adding fees or charges, we will provide you advance notice of those changes. If you do not accept the changes, we may discontinue providing the applicable part of the Services to you. Our authorized third-party payment processors will charge the payment method you specified at the time of purchase or as agreed to as part of the selected Service. You authorize us to charge all fees as described in these Terms of Use for the Services you select to that payment method.

  8. Subscriptions

    1. The Services may include features that allow for automatically recurring payments for periodic charges (“Subscription Service”). If you decide to activate a Subscription Service, you authorize us to periodically charge, on a going-forward basis and until cancellation of either the recurring payments or your Account, all accrued sums on or before the payment due date for the accrued sums. The subscription will continue unless and until you cancel your subscription, or we terminate it. You must cancel your Subscription Service before it renews in order to avoid billing of the next periodic subscription fee to your account. We will bill the periodic subscription fee to the payment method you provide to us during registration (or to a different payment method if you change your payment information). We may change the subscription fee for any subsequent subscription period but will provide you advance notice of any increase before it applies.

  9. Personal Data

    1. When registering for your Account or interacting with other services offered by us via our Website it may be necessary for you to provide some personal information to us. We will keep your personal information secure and will use it only in accordance with our Privacy Policy. All personal information held by us will be held in accordance with the terms of applicable data protection laws.

    2. By submitting an ad to us, you are requesting that your ad appears on propertymap.mu. This means that the ad and all information contained within it can potentially be viewed by all persons with internet access throughout the world. You consent to the publication of your data in this way.

    3. You acknowledge and agree that by placing an ad with us, you will provide us with and we will collect from you certain personal data relating to you (e.g. name, address and contact details). This personal data will be processed in accordance with our Privacy Policy and may be used for a number of purposes (as further detailed in our Privacy Policy) and which may include marketing communication from propertymap.mu and/or third-party service providers appointed by us for that purpose. If you do not wish to receive marketing communications from the Website, simply indicate this on the account profile page once signed in to propertymap.mu, or at any time by emailing.

  10. General Advertising Guidelines

    1. The following is a partial list of our advertising guidelines:
      1. The advertising content must be clearly identifiable as an advertisement.
      2. The advertiser must fulfill the advertised offer as stated in the advertisement, including without limitation, not altering any offer periods, product offers or prices that are stated in the advertisement.
      3. Ads cannot mislead the user.
      4. Ads cannot solicit or collect, or appear to solicit or collect, any personally identifiable information from propertymap.mu users without their knowledge.
      5. Agent banners are for branding purposes only and may only link to the agency’s website or an agent’s profile on the agency’s website. Agency banners are not, under any circumstances, permitted to link to any webpage that promotes any property or project
      6. User clicks on ad creative may not result in the launch of multiple browser windows.

  11. Mapping Functionality

    1. The Services implements the OpenStreetMap and GoogleMap services.

    2. When posting Ads to the Website, you are required to pin the location of the property being advertised on the OpenStreetMap. The pin location must provide viewers with a realistic location of the property being advertised. Advertised property without pin location on the OpenStreetMap will not be posted to the Website. In the event that we became aware and/or are informed that the property being advertised bears a wrong pin location, we reserve the right to disactivate the Ads without notice and without any compensation whatsoever until you rectify the pin location.

  12. Advertisers Materials

    1. Certain portions of the Services may allow Advertisers to upload or otherwise provide propertymap.mu images, photos, video, data, text, listings, and other content (“Advertisers Materials”). You are solely responsible and liable for all data, information and other materials that you submit, upload, post, email or otherwise transmit (“Transmit”) in connection with the Services. In addition, we have no control over, and shall have no liability for, any damages resulting from the use (including without limitation republication) or misuse by any third party of information made public through the Services. If you choose to submit to us, or otherwise make any personal information or other information publicly available, you do so at your own risk and company shall have no responsibility or liability therefor.

    2. By uploading or otherwise providing Advertisers Materials to the Services, you grant us an irrevocable, perpetual, royalty-free worldwide license to:
      • use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, modify, prepare derivative works of or incorporate into other works, and translate your Advertisers Materials, in connection with the Services or in any other media; and
      • sublicense these rights, to the maximum extent permitted by applicable law.
      We will not pay you for your Advertisers Materials or to exercise any rights related to your Advertisers Materials set forth in the preceding sentence. We may remove or modify your Advertisers Materials at any time. You are solely responsible for all Advertisers Materials made through your Account(s) or that you otherwise make available through the Services. For all Advertisers Materials, you represent and warrant that you are the creator and owner of the Advertisers Materials, or have the necessary licenses, rights, consents, and permissions (including all permissions required under applicable privacy and intellectual property law) to authorize propertymap.mu and other users to access and use your Advertisers Materials as necessary to exercise the licenses granted by you under these Terms of Use.

    3. We are under no obligation to edit or control your Advertisers Materials or the Advertisers Materials of any other user and will not be in any way responsible or liable for any Advertisers Materials. We may, however, at any time and without prior notice, screen, remove, edit, or block any Advertisers Materials content on the Services, including Advertisers Materials, that in our sole judgment violates these Terms of Use or we find otherwise objectionable. We expressly disclaim any and all liability in connection with Advertisers Materials. If notified by a user or content owner that Advertisers Materials allegedly do not conform with these Terms of Use, we may investigate the allegation and determine in our sole discretion whether to remove those Advertisers Materials, which we reserve the right to do at any time and without notice and without providing a refund.

  13. Prohibited Activities

    1. The following is a partial list of the kinds of activities that are prohibited on or through the Website:
      • submitting Advertisers Materials that are patently offensive to the online community, such as content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
      • engaging in activities or submitting Advertisers Materials that could be harmful to minors;
      • engaging in activity or submitting Advertisers Materials that harasses or advocates harassment of another person;
      • engaging in activity that involves the transmission of "junk mail" or unsolicited mass mailing or "spam" or harvesting or otherwise collecting personally identifiable information about Website users, including names, phone numbers, addresses, email addresses, (collectively, "User Data") without their consent;
      • engaging in activity, or submitting Advertisers Materials, or promoting information that is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
      • submitting Advertisers Materials that contain restricted or password only access pages, or hidden pages or images;
      • submitting Advertisers Materials that displays pornographic or sexually explicit material of any kind;
      • submitting Advertisers Materials that provide instructional information about illegal activities, violating someone’s privacy, or providing or creating computer viruses;
      • submitting Advertisers Materials that contain viruses, Trojan horses, worms, or any other similar forms of malware,
      • engaging in activities or submitting Advertisers Materials that solicit passwords or personally identifiable information for unlawful purposes from other users;
      • using any robot, spider, other automatic device, or manual process to monitor, copy, or "scrape" web pages or the content contained in the Website or for any other unauthorized purpose without the Company’s prior written consent;
      • using any device, software, or routine to interfere or attempt to interfere with the proper working of the Website;
      • decompiling, reverse engineering, or disassembling the software or attempting to do so; or
      • taking any action that imposes an unreasonable or disproportionately large load on the Website or the Company’s hardware and software infrastructure or that of any of its licensors or suppliers.

  14. Services Content

    1. The Services and all material contained therein, all text, graphics, Applications, images, the design and coding, all computer programs used and licensed in connection with the Services, the business process, procedures, methods and techniques used in or in connection with the Services, the look and feel of the Services, and all data and reports generated by the Services (collectively, the “Services Content”) are owned by us or a third party. These materials are protected under copyright, trademark and other laws. You may not copy, download, transmit, modify, distribute or republish the Services or any portion of the Services, including without limitation any of the Services Content without the prior written consent of Company. You may not sell, publicly display, create derivative works of, reverse engineer, assign, sub-license, transfer or otherwise exploit the Services or any Services Content. Use of any Services Content is prohibited without the prior written permission of Company.

    2. As long as you comply with these Terms of Use, Company grants you a personal, non-exclusive, non-transferable, non-sublicensable right to access and make use of the Services in compliance with these Terms of Use. You shall not, and shall not permit anyone else to, directly or indirectly:
      • remove or alter proprietary notices or labels on or in the Services or Services Content;
      • engage in any activity that interferes with or disrupts the Services or Services Content;
      • engage in any fraudulent activity or activity that facilitates fraud; or
      • otherwise act in violation of these Terms of Use.
      All rights not expressly granted herein are reserved.

  15. Term & Termination

    2. You acknowledge and agree that Company may terminate your account or access to use of the Services for any reason, including, without limitation, your violation of these Terms of Use. You agree that Company may terminate your access to and use of the Services without prior notice and without any liability to you or any third party. You acknowledge and agree that Company may modify, limit, suspend or discontinue the Services or any part of the Services at any time, without notice or liability to you. The Company may also, from time to time, establish general rules and policies regarding use of the Services. Company will post such rules and policies on the Services, and you agree that your compliance with such rules and policies shall be a condition of your use or continued use of the Services.

    3. The Company shall have no liability or responsibility with respect to any lost Services Content, Advertisers Materials, or other data, such as the deletion of or failure to store Services Content, Advertisers Materials, or other data.

  16. Linked Sites

    1. The Company has not reviewed all of the websites linked to the Services and is not responsible for the content of any third-party pages or any other websites linked to the Services. Nothing in the Services, including, without limitation, any links to other websites, should be construed as an endorsement of any products, services or information of any other persons or companies by Company. Your choice to link to any other website is at your own risk, and you agree to comply with all terms and conditions relating to such websites. Company reserves the right not to link, or to remove the link, to a particular website at any time. Any links to third party websites are provided as a convenience to you and are neither owned nor operated by Company. Company has no control over these linked websites and makes no representations or warranties with respect to these linked websites. Your viewing and use of any third party websites is at your sole discretion and risk.

  17. Disclaimer

    1. The Website is provided ‘as is’, without warranty of any kind either express or implied. Without limiting the foregoing:
      1. propertymap.mu explicitly disclaims any warranties of merchantability, fitness for a particular purpose, quiet enjoyment or non-infringement, and any warranties arising out of course of dealing or usage of trade.
      2. propertymap.mu makes no warranty that the Website or Services or any website referred to by it including but not limited to, the listings will meet your requirements or that the Services will be available on an uninterrupted, secure or error-free basis.

    2. The Company makes no warranty regarding the quality of any listings or the accuracy, timeliness, truthfulness, completeness or reliability of any content available through the Website or Services. The Company has no control over the content contained in any listings and the condition, legality or suitability of any property. The Company is not responsible for and disclaims any and all liability related to any and all listings and properties.

    3. You acknowledge and agree that the Company is not a party to any agreement entered into between you and a seller or any other third party. The Company has no control over the conduct of such parties and disclaims all liability in this regard to the maximum extent permitted by law. Furthermore, if a dispute arises between a buyer and seller or any other third party, both parties agree that the Company will not be involved in the dispute and has no liability whatsoever in relation to such disputes.

    4. No advice or information, whether oral or written, obtained from the Company or through the Website or Services will create any warranty unless expressly made herein.

    5. The Company provides no guarantee that the Property will sell as a result of your using our Service. Failure to sell a property can be for any number of reasons unconnected to the provision of our Services.

  18. Indemnification

    1. You agree to indemnify us and keep us fully and effectively indemnified from and against any claims, liabilities, costs or damages, including reasonable attorneys’ fees, made by any third party, relating to or arising from
      • your use of the Services,
      • your interactions with other users of the Services,
      • any Advertisers Materials that you Transmit to or through the Services, including without limitation any intellectual property,
      • any violation of these Terms of Use by you,
      • your non-compliance with any law or regulation, or
      • any other act or omission by you, including your violation of any rights of another, arising from your use of the Services.

  19. Limitation of Liability

    1. You expressly understand and agree that, to the extent permitted by applicable laws, the Company shall not be liable for any indirect, incidental, special or consequential including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the Services.

    2. To the extent permitted by applicable laws, in no event shall the Company be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our Website, our Services or these Terms of Use (however arising including negligence). You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, the Company’s partners, officers, directors, agents, employees, and suppliers harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Use or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

    3. The maximum liability of company and the affiliated entities for all damages, losses and causes of action, whether in contract, tort or otherwise will be the total amount, if any, paid by you for the Subscription Service during the six months preceding the event giving rise to liability.

    4. We are not liable in any way for failure, interruption, delay or any other matters of a similar nature whatsoever to propertymap.mu arising out of circumstances beyond our reasonable control including, but not limited to, fire, explosion, earthquake, flood, storm, riot, civil disturbance, strikes, lockouts and industrial disputes, war, nuclear accident, terrorist activity, failure of equipment or transmission (or other supply) difficulties, the act or order of any government department, lockdown, pandemic and acts of God.

  20. Variation

    1. We reserve the right to vary these Terms of Use from time to time. Such variations become effective immediately upon the posting of the varied Terms of Use on our Website. By continuing to use our site you will be deemed to accept such variations.
    2. Please check our Website regularly to ensure you are familiar with the current version of the Terms of Use, Additional Terms and Privacy Policy. If you do not accept any of the modifications, revisions or amendments to these Terms of Use, you should stop using our site and the services offered by us immediately.

  21. Severability

    1. If any term of these Terms of Use is held to be invalid or unenforceable, the remainder of these Terms of Use shall remain valid and enforceable.

  22. Entire Agreement

    1. These Terms of Use constitute the entire agreement between you and us in relation to your use of our Website and supersede all previous agreements in respect of such use.
    2. These Terms of Use will be governed by Mauritian law, and any disputes will be subject to the exclusive jurisdiction of the Mauritian courts.
